Introduction: Expat Tax Wyoming Planning for British Families

The expat tax Wyoming story usually begins and ends with one sentence: Wyoming has no personal income tax. That sentence is true, and for a British family arriving in Jackson Hole, Wilson or Teton Village it is genuinely valuable. However, it is also the reason so many newcomers stop thinking about tax at exactly the moment the real exposure begins. The Internal Revenue Service still taxes your worldwide income from the day you become a US tax resident, HMRC still taxes your London rental flat, and the state you left may well argue that you never left at all.

This guide is written for private equity partners, founders, family business owners and senior executives who have moved from London to the Teton valley, or who are about to. It also speaks to American-British dual nationals who have kept a home in Wyoming while working in the City. Throughout, we explain how the expat tax Wyoming position interacts with your federal return, with HMRC and with the foreign account reporting that most new arrivals miss in their first year.

Expat Tax Wyoming Basics: Two Tax Systems That Still Bite

When there is no state income tax, the planning problem narrows rather than disappears. In practice, a wealthy British household in Wyoming deals with two income tax systems, the IRS and HMRC, plus a Wyoming property and sales tax regime that falls hardest on exactly the kind of property HNW arrivals buy. Moreover, because Wyoming files nothing for you, there is no state return to act as a safety net; every error lands on the federal Form 1040 instead.

Who This Expat Tax Wyoming Guide Is Written For

We assume you are a British national who is, or will shortly be, resident in the United States for tax purposes, whether through a green card, an L-1 or E-2 visa, or simply by passing the IRS substantial presence test. We also assume you hold meaningful UK assets: a workplace pension or SIPP, an ISA, a share portfolio, perhaps a London property you now let. If you are an accidental American who grew up in Britain and has just bought in Jackson, the same rules apply, with the added complication of any earlier years you never filed.

Expat Tax Wyoming Compared With Other No-Tax States

Wyoming sits alongside Nevada, Texas, Florida, Tennessee, South Dakota, Alaska, Washington and New Hampshire as a state without a broad personal income tax. Unlike Washington, it has no separate capital gains charge, and unlike New Hampshire it has no historic tax on interest and dividends. We have compared the other options in our guides to British expat tax in Las Vegas and Nevada and to neighbouring Montana, where a short drive north brings a full income tax back into play.

What "No State Income Tax" Really Means for Expat Tax Wyoming Planning

The phrase is accurate but incomplete. Wyoming does not tax wages, salaries, bonuses, carried interest, dividends, interest, pensions or capital gains of individuals. Consequently, there is no Wyoming return to file, no state residency form to complete and no state foreign tax credit question of the kind that troubles British families in Chicago, where Illinois gives no credit for UK tax. Nevertheless, the absence of a return creates its own problems, and the expat tax Wyoming advantage is narrower than most relocation brochures suggest.

No Return Means No Paper Trail

In a state with an income tax, a resident return is itself evidence of where you live. In Wyoming you have nothing equivalent to show a former state that challenges your move. Therefore the burden shifts to the ordinary records of life: a Wyoming driving licence, vehicle registration, voter registration, the address on your brokerage and bank statements, and the location of your doctors, clubs and children's schools. The Wyoming Department of Revenue administers sales, use and property taxes, but it does not issue any certificate of residence for income tax purposes, because there is no income tax to certify.

Business Income and the Absence of a Corporate Tax

Wyoming also levies no corporate income tax. For a founder who runs a holding company or an operating business from Jackson, that removes a layer most states would add. However, the federal rules on controlled foreign corporations, GILTI's successor regime and pass-through income apply in full, and the UK may still tax a British company that is managed from the Teton valley if its directors continue to meet in London. In short, for expat tax Wyoming purposes, the state removes its own layer only.

Expat Tax Wyoming and the Sales Tax on Your First Purchases

The state sales tax rate is 4%, and Teton County adds a further 3%, giving a combined 7% in Jackson. Some districts, including Teton Village, add special levies that push the combined rate higher. A family furnishing a new home, buying vehicles and equipping a ranch can easily pay six figures of sales and use tax in the first year, and none of it is creditable against federal income tax. Moreover, use tax applies to goods bought out of state and brought into Wyoming, which catches the furniture shipped from London.

Teton County Property Tax: The Expat Tax Wyoming Bill Nobody Mentions

Property tax is where Wyoming collects its revenue from wealthy households, and it is the part of the expat tax Wyoming picture that newcomers most often misjudge. Residential property is assessed at 9.5% of fair market value, and the local mill levy is then applied to that assessed figure. In Teton County the combined levy is roughly 50 mills, which produces an effective rate of a little under half a percent of market value. On a $6 million Jackson Hole home, that is still a bill of more than $28,000 a year.

The 25% Exemption on the First $1 Million

Senate File 69, passed in 2025, exempts 25% of the first $1 million of fair market value of a single-family residence, including condominiums and townhouses. The relief is capped by value, so on a high-value Teton County home it is worth about $1,200 a year at a 50-mill levy. Crucially, the exemption now applies only to owner-occupied homes, and the owner must live in the property for at least eight months of the year. Homeowners apply by affidavit to the county assessor, and the deadline for the 2026 tax year was 1 March 2026.

Why Second-Home Owners From London Lose Out

A British family that keeps its main home in Kensington and spends the ski season and summer in Wilson will not meet the eight-month test. Therefore the exemption is unavailable, the full assessed value is taxed, and the expat tax Wyoming saving on the house is smaller than expected. This is the mirror image of the residency problem discussed below: the facts that would protect you from a former state's audit are the same facts that qualify you for the exemption, so the two should be planned together.

The Long-Term Homeowner Exemption

A separate 50% exemption exists for homeowners aged 65 or over who have paid Wyoming residential property tax for at least 25 years and who live in the home as their primary residence. The exemption is currently legislated to run until 2027 unless it is extended, and few British arrivals will qualify for many years. Nevertheless, a returning Wyoming-born dual national who has kept a family home through decades in London may already meet the test, and it is worth checking with the assessor before assuming otherwise.

Property Tax and the Federal SALT Cap

Wyoming property tax is deductible on your federal return as a state and local tax, but only within the SALT cap. For 2026 the cap is $40,400, phasing down by 30 cents for every dollar of modified adjusted gross income above $505,000, with a floor of $10,000. A married couple with income above roughly $606,000 is therefore back at the $10,000 floor. Consequently, a Jackson Hole family paying $28,000 of property tax deducts $10,000, exactly as a family in New York or California would.

Federal Tax on Your UK Income: The Heart of Expat Tax Wyoming

Once you are a US tax resident, the IRS taxes your worldwide income at rates up to 37%, plus the 3.8% net investment income tax on investment income. Wyoming's zero rate does nothing to reduce that, which is the point most expat tax Wyoming articles leave out. For a British household with substantial UK assets, the federal return is where almost all of the expat tax Wyoming risk lives.

UK Workplace Pensions and SIPP Withdrawals

Under Article 17(1)(a) of the US-UK income tax treaty, a pension paid from a UK scheme to a US resident is taxable only in the United States. You should therefore ask HMRC for a no-tax code using Form DT-Individual, so that the scheme stops deducting UK tax at source. Furthermore, Article 17(1)(b) exempts in the US any portion of the pension that would be exempt in the UK if you were still resident there. In practice, that means the 25% tax-free element of each uncrystallised funds pension lump sum is also exempt from federal tax, and Article 1(5) of the treaty preserves that relief even for green card holders and US citizens.

The One-Off Tax-Free Lump Sum

A single pension commencement lump sum is more contentious. The treaty has a separate rule for lump sums in Article 17(2), and that paragraph is not among the savings-clause exceptions, so the IRS can argue that a US resident is fully taxable on it. Many practitioners nevertheless take the position that the UK tax-free cash is protected by Article 17(1)(b). Whichever view you adopt, the position must be disclosed on Form 8833, and the timing of a large withdrawal is best decided before, rather than after, you arrive in Wyoming.

The UK State Pension

Article 17(3) makes social security benefits taxable only in the country where the recipient lives, so a Briton resident in Wyoming pays no UK tax on the State Pension. However, the IRS does not treat it like American Social Security. According to IRS Publication 915, foreign social security is taxed as an annuity unless the treaty says otherwise, and the UK treaty does not. The State Pension is therefore fully taxable on your federal return, not 85% taxable, a point we cover in detail in our guide to the UK State Pension for Britons in America.

ISAs, UK Funds and the PFIC Problem

An ISA is invisible to the IRS as a tax wrapper. Interest, dividends and gains inside it are taxable each year on your federal return. Worse, most UK unit trusts, OEICs and ETFs are passive foreign investment companies, which means punitive default taxation and an annual Form 8621 for each fund. A family that arrives with a large ISA and a portfolio of UK funds can spend more on compliance than the funds earn. As a result, the most effective expat tax Wyoming planning usually happens in the final UK tax year, by selling UK funds and reinvesting in individual shares or US-domiciled funds before US residence begins.

Pre-Arrival Gains Have No Fresh Start

The United States gives no step-up in basis when you become resident. If you bought shares in London for £400,000 and they are worth £1.4 million on the day you land in Jackson, a later sale is taxed by the IRS on the full gain since purchase, at up to 20% plus the 3.8% investment surcharge. Wyoming adds nothing, but nor does it help, so expat tax Wyoming planning has to start in London. For that reason, realising gains while still UK resident, and paying UK capital gains tax at 24%, is sometimes no worse than waiting, and it removes both the PFIC risk and the exposure described in the next section.

The UK Side: Leaving Britain Properly

Moving to Wyoming does not end your relationship with HMRC. Your UK residence in the year of departure is decided by the statutory residence test, and split-year treatment can divide that tax year into a UK part and an overseas part. Nevertheless, several UK charges follow you to the Rockies, and they belong in any serious expat tax Wyoming plan.

Temporary Non-Residence

If you were UK resident for at least four of the seven tax years before you left and you return within five years, gains realised while abroad on assets you owned when you departed can be taxed in the year you come back. In other words, selling a UK business or a large share portfolio from Jackson Hole is not automatically outside UK capital gains tax. HMRC explains the wider rules in its guidance on tax when you live abroad or return to the UK. Consequently, anyone who might return to London within five years should plan disposals with both systems in view.

Your London Flat Becomes a Non-Resident Let

Rent from UK property remains taxable in the UK, whatever Wyoming does. Under the non-resident landlord scheme, your letting agent or tenant must withhold basic-rate tax unless HMRC approves you to receive rent gross. UK property income rates rise by two percentage points from April 2027, and withholding rises with them. The IRS taxes the same rent, with a foreign tax credit for the UK tax, but the 3.8% net investment income tax on that rent cannot be offset by UK tax.

Keeping the UK Personal Allowance

For expat tax Wyoming clients, one UK relief survives the move. British nationals living abroad generally keep the UK personal allowance, so the first £12,570 of UK income is still tax-free. That allowance usually absorbs a modest UK rental profit or a small UK pension that falls outside the treaty. Moreover, it means your non-resident Self Assessment return can be a straightforward document, provided it correctly claims the treaty exemption for your UK pension and State Pension.

Expat Tax Wyoming Residency Battles: The State You Left May Not Let Go

For many British families, Wyoming is their second American home. They arrived first in New York, San Francisco or Los Angeles and moved to Jackson Hole for the lifestyle and the tax position. That is where the most expensive expat tax Wyoming disputes arise, because high-tax states audit departures aggressively.

California's Closest-Connection Approach

California looks at the whole pattern of your life to decide whether you have truly left. If you keep a house in Malibu, a family office in San Francisco and doctors in Los Angeles, a Wyoming driving licence will not carry the day. Furthermore, California continues to tax income sourced to the state after you leave, including restricted stock units and options that vested partly for work done there. We explain the treaty position in our guide to why California ignores the US-UK treaty on UK pensions, and the same refusal to give a foreign tax credit applies to any period in which it treats you as resident.

New York's Statutory Residence Test

New York treats you as a resident if you keep a permanent place of abode there and spend more than 183 days in the state, even if your domicile is elsewhere. Therefore an expat tax Wyoming family that keeps a Manhattan apartment and splits time between New York and Jackson must keep meticulous day records. The New York Department of Taxation's nonresident guidance also requires certain income items to be accrued on the day you change residence, which catches deferred bonuses and carried interest.

Building a Wyoming Domicile That Holds

Domicile is your permanent home, the place you intend to return to. To establish a Wyoming domicile that survives challenge, you should move the things that matter: your family, your main home, your valuables, your professional advisers and your social life. You should also sell or let the old home on commercial terms rather than keeping it available. Our cross-border planning service builds this expat tax Wyoming evidence file from the first day, because reconstructing it during an audit is far harder.

Expat Tax Wyoming Reporting: FBAR, Form 8938 and Missed Years

Becoming a US tax resident switches on the full American information-reporting regime. Every UK bank account, ISA, pension and brokerage account must be reported once your total balances exceed $10,000 at any time in the year, on the FinCEN FBAR. In addition, a married couple living in the United States files Form 8938 once foreign assets exceed $100,000 at year end or $150,000 at any time, as the IRS comparison of Form 8938 and FBAR requirements explains.

The First-Year Trap

The first year of US residence is usually a dual-status year, with residence starting on a date set by the IRS residency starting and ending date rules. Many arrivals assume that a part-year means no FBAR, but if you are a US person at any point and your UK balances exceeded $10,000 during your period of residence, the obligation applies. Consequently, the first expat tax Wyoming return is the one most likely to be incomplete.

Putting Missed Years Right

If you have already missed an FBAR, Form 8938 or PFIC filing, the position is usually recoverable, provided the failure was not wilful and you act before the IRS contacts you. Our FBAR and FATCA service prepares the missing reports and the explanatory statement, and our tax treaty optimisation team reviews any treaty positions that were never claimed. Above all, in any expat tax Wyoming catch-up, do not file the current year correctly and ignore the earlier ones, because that creates a visible gap.

Expat Tax Wyoming Case Study: A Private Equity Partner's Family in Wilson

Daniel and Sophie Hart, both British nationals, moved from Hampstead to Wilson, Wyoming, in June 2026 after Daniel's firm opened a US office. Daniel holds an L-1 visa and passed the substantial presence test in 2026; Sophie followed on a dependent visa. They bought a $5.5 million home and, because they live there year-round, they will meet the eight-month owner-occupancy test from 2027. The figures below are for 2027, their first full year, and are rounded.

The Income

Daniel earns a US salary of $780,000. They let their former London flat for a net profit of £48,000, which is about $64,800 at an exchange rate of 1.35. Sophie draws £80,000 ($108,000) from her SIPP as an uncrystallised funds pension lump sum, of which 25%, or £20,000 ($27,000), is the UK tax-free element. Before arriving, they sold £600,000 of UK funds from their ISAs and general accounts, paying UK capital gains tax in the UK part of the 2026/27 split year and avoiding any PFIC filings.

The Expat Tax Wyoming Calculation

Wyoming income tax is nil, which is the headline expat tax Wyoming benefit. Their home is assessed at 9.5% of $5.5 million, or $522,500, and at a 50-mill levy that produces a bill of $26,125. The 25% exemption on the first $1 million reduces the assessed value by $23,750, saving $1,188, so the net bill is about $24,937. Their modified adjusted gross income of roughly $926,000 places them at the $10,000 SALT floor, so only $10,000 of that property tax is deductible federally.

The Federal and UK Calculation

Because of Article 17(1)(b), the $27,000 tax-free element of Sophie's withdrawal is excluded from federal income, and the remaining $81,000 is taxed only in the US after HMRC issued a no-tax code. On the London flat, HMRC charges roughly £7,100 at current rates after the personal allowance, and the IRS taxes the same $64,800 with a foreign tax credit for the UK tax. However, the 3.8% net investment income tax on the rent, about $2,460, is a pure cost. As with every expat tax Wyoming household holding UK assets, they also file FBARs and Form 8938 for the SIPP, the remaining ISA cash and their UK current accounts.

What Was Saved and What Was Lost

Had the Harts settled in California on the same income, their state income tax would have been roughly $85,000. California would also have taxed the full $108,000 SIPP withdrawal, because it ignores the treaty's exemption. Property tax favours Wyoming too: under Proposition 13 a $5.5 million California purchase would typically be taxed at about 1.1% of the price, or roughly $60,000 a year, against their $24,937 in Teton County, while the SALT deduction is capped at $10,000 in both states. Overall, Wyoming saves them well over $100,000 a year, but only because the pension, the London rent and the pre-arrival fund sales were all planned. Had they kept the UK funds, their expat tax Wyoming result would have been far worse: PFIC charges and filing costs would have eroded a meaningful part of that saving.

How TaxYork Can Help

TaxYork prepares federal returns, UK Self Assessment returns and the related information reports for British families across the United States, including in the Teton valley. We prepare comprehensive expat tax Wyoming returns, not general guidance, and we prepare both countries' filings together, so the treaty positions on one side match the figures on the other.

Expat Tax Wyoming Returns Prepared as One File

Our team handles the dual-status first year, the Form 8833 treaty disclosures, the PFIC elections, the FBAR and Form 8938, and the UK non-resident return for your London property. For expat tax Wyoming clients, we also keep the domicile evidence file that protects you from a California or New York audit, and we review the property tax exemption each year before the 1 March deadline.

Founders, Investors and Dual Nationals

Many of our expat tax Wyoming clients are founders selling businesses, investors with UK portfolios, or dual nationals who have been filing in only one country. If you have missed US tax returns, missed an FBAR or missed reporting a UK pension or ISA, we can prepare the missing years and bring you into full compliance before the IRS asks. You can read more in our complete guide to UK expat tax in the USA.

Conclusion

The expat tax Wyoming advantage is real, but it is a state-level advantage only. For a wealthy British family in Jackson Hole, the money is won or lost on the federal return, in the treatment of UK pensions and funds, in the choice of when to realise UK gains, and in the strength of the evidence that you really have left California or New York. Furthermore, the property tax system rewards year-round residence and penalises second homes, so the way you live in Wyoming affects what you pay. In short, treat expat tax Wyoming planning as a pre-move exercise, plan the move before you make it, and file both countries' returns as one coordinated set.

Frequently Asked Questions

No. For expat tax Wyoming purposes the answer is simple: Wyoming has no personal income tax, so UK workplace pensions, SIPP withdrawals and the UK State Pension carry no Wyoming tax. However, the IRS taxes UK pensions paid to a US resident under Article 17 of the US-UK treaty, apart from the portion that would be tax-free in the UK.

Usually only on UK-source income such as rent from a London property, which stays taxable in the UK under the non-resident landlord scheme. UK pensions paid to a US resident are taxable only in the US once HMRC issues a no-tax code. Gains may also be taxed on return under temporary non-residence rules.

Yes. The treaty makes it taxable only in the country where you live, so a Wyoming resident pays no UK tax on it. The IRS, however, taxes the full amount as an annuity rather than as Social Security, so the 85% limit that applies to American Social Security does not apply.

In expat tax Wyoming cases there is no state return or residency form, so the evidence comes from your life: a Wyoming driving licence, vehicle and voter registration, your main home, your family's location and your professional advisers. Former high-tax states such as California and New York will test that evidence if you claim to have left.

Residential property in Wyoming is assessed at 9.5% of market value, and Teton County applies a combined levy of roughly 50 mills. The effective rate is a little under half a percent of market value. Owner-occupiers living there eight months a year can also exempt 25% of the first $1 million of value.

Yes, if you are a US tax resident and your non-US accounts exceed $10,000 in total at any time during the year. Green card holders, visa holders who pass the substantial presence test and dual nationals must report UK bank accounts, ISAs and pensions. Married couples living in the US also file Form 8938 above $100,000.

No. Expat tax Wyoming rules follow federal law, and the IRS does not recognise an ISA, so income and gains inside it are taxable on your federal return each year. Most UK funds held in an ISA are also passive foreign investment companies, which require Form 8621 and punitive default tax. Selling them before you become US resident is often the cleanest solution.
