Introduction: Expat Tax Las Vegas Planning Without a State Return

The expat tax Las Vegas position is the simplest in this series, and that simplicity is exactly where clients go wrong. Nevada levies no personal income tax, and its constitution forbids one. Consequently, there is no state credit to argue about. There is no state residency computation and no third return. Everything therefore rests on the federal return and on what HMRC still charges you.

At TaxYork, we prepare returns for British casino and hospitality executives, construction and logistics owners, consultants, professional gamblers and retirees across Las Vegas, Summerlin and Henderson. In our experience, families arriving from California celebrate the missing state tax and then lose the same money three other ways. Therefore the expat tax Las Vegas question is not what Nevada charges. It is what Nevada leaves entirely to Washington and London.

Expat Tax Las Vegas Basics: Two Systems, Not Three

A British household in Las Vegas deals with two income tax systems rather than the usual three. First, federal income tax reaches worldwide income, softened by the foreign tax credit on IRS Form 1116. Second, the United Kingdom continues to tax UK property, UK land disposals and UK workdays. Nevada adds nothing. Accordingly, the expat tax Las Vegas outcome depends entirely on how well those two systems are made to fit together.

Who This Guide Is Written For

This guide addresses high-net-worth British nationals, dual national US UK families and accidental Americans across the Las Vegas valley. Specifically, it suits company owners, investors, senior executives, gaming professionals and retirees who arrive holding UK property, pensions and portfolios. If you have moved from a high-tax state, or you are weighing Nevada against Florida or Texas, the expat tax Las Vegas rules below decide how much of that saving you keep.

How Las Vegas Compares With the Other Cities We Cover

The contrast with our other city guides is total. Portland stacks Oregon and two local taxes for nearly 13.9%. Minnesota charges 9.85% plus a 1% investment surtax. Philadelphia adds a city tax to a low state rate. Nevada charges none of it. Consequently, Las Vegas sits alongside Miami and Texas as one of the three cheapest places in this series for a British household.

What This Guide Does Not Claim

No state income tax does not mean no tax. It means the burden moves. Nevada recovers its revenue through sales tax, property tax and business levies. Meanwhile, the federal bill is unchanged. Therefore the honest expat tax Las Vegas comparison weighs the whole package rather than the headline.

The Constitutional Ban and Why It Is Durable

Most states could introduce an income tax next session. Nevada cannot, and that permanence gives the expat tax Las Vegas position unusual planning value.

What Article 10 Actually Says

The Nevada Constitution provides that no income tax shall be levied upon the wages or personal income of natural persons. The prohibition sits in Article 10, section 1. It is not a policy choice that a legislature can reverse in a budget crisis. Consequently, the absence of state income tax is a structural feature rather than a temporary one.

How Hard It Would Be to Change

Amending the Nevada Constitution requires approval by the legislature in two consecutive sessions, followed by a majority of voters at a referendum. That is a multi-year process with a public vote at the end. Therefore a British family making a ten-year plan around Nevada residency is on firmer ground than one relying on a low statutory rate elsewhere.

Compare That With Washington State

Structural durability matters because rates move. Washington also has no income tax, yet it introduced a capital gains tax in recent years and has faced repeated ballot fights over an income tax, as we cover in our guide to British expats in Seattle. Nevada's constitutional bar makes that path considerably harder. Accordingly, the expat tax Las Vegas position carries less political risk than most alternatives.

What the Ban Does Not Cover

Read the wording carefully. It protects the wages and personal income of natural persons. It does not prevent taxes on business gross receipts, on payroll paid by employers, on property or on consumption. Nevada uses all of those instead, which is the subject of the next section.

What Nevada Charges Instead

The revenue has to come from somewhere, and in an expat tax Las Vegas budget it arrives in three places.

Sales Tax at 8.375% in Clark County

Clark County applies a combined sales tax rate of 8.375% for 2026. That is the 4.6% state rate plus 3.775% of county and local additions. That is materially higher than most states. Unlike Oregon, there is no zero-rate alternative, so the expat tax Las Vegas saving is partly recovered through spending. Consequently, a household that spends heavily on goods gives back part of the income tax saving at the till.

The Property Tax Cap, and the Trap for Landlords

Nevada limits how fast a property tax bill can rise. Under NRS 361.4723, an owner-occupied primary residence enjoys a 3% annual cap on the tax bill. However, a cap of up to 8% applies to everything else. That includes residential property that is let rather than occupied, land and commercial buildings. Therefore a British family that buys a Summerlin house to rent out sits under the 8% cap, not the 3% one.

Why That Distinction Costs Real Money

The difference compounds. A bill capped at 3% and a bill capped at 8% diverge sharply across a decade of ownership. Moreover, the favourable cap attaches to occupation rather than to nationality or visa status. It is therefore available to a British owner who actually lives in the property. Consequently, we check the cap classification on every expat tax Las Vegas property purchase, because correcting it later is harder than claiming it correctly at the outset.

Business Levies for Owners

Nevada charges a Commerce Tax on business gross revenue above a threshold, and a Modified Business Tax on payroll. Neither appears in a typical expat tax Las Vegas projection. Neither is an income tax, so neither is creditable against UK tax as an income tax would be. Accordingly, a British owner running a Nevada company should model these separately. Assuming the state takes nothing is a costly expat tax Las Vegas error.

Your Federal Return Now Carries Everything

With no state layer, every dollar of expat tax Las Vegas relief has to come from the federal return or the treaty.

The Foreign Tax Credit Does the Heavy Lifting

UK tax on UK rents, UK workdays and UK land gains is relieved through the foreign tax credit. No state return competes for the same income. The federal computation is therefore the whole expat tax Las Vegas game. Consequently, basket allocation, sourcing and carryovers matter more here than in a state that taxes you anyway. Our treaty and double tax relief service handles that analysis.

The Foreign Earned Income Exclusion

The foreign earned income exclusion reaches $132,900 for 2026. It applies only to earned income while you live and work abroad, so it rarely helps a family settled in Las Vegas. Nevertheless, it matters in the year you arrive or the year you leave. Therefore the expat tax Las Vegas arrival year deserves the same care as in any other city.

Treaty Positions Still Matter

In a state with an income tax, a treaty exemption is valuable twice over because it also removes income from the state base. In Nevada there is no second benefit, but the federal benefit is undiminished. Accordingly, positions on UK pensions and lump sums under the US-UK double taxation convention remain central to the return.

Where Nevada Genuinely Helps

The real saving appears on income that the foreign tax credit cannot shelter. UK dividends carry no UK tax for a non-resident, and income inside an ISA carries none either. In a state like Minnesota or Oregon, that income is taxed at up to 10% with no credit available. In Nevada it simply escapes state tax. Consequently, the expat tax Las Vegas advantage is largest for households whose UK income is investment income rather than rent.

UK Property, Pensions and Portfolios From Las Vegas

Your UK assets behave the same way here as anywhere. What changes in an expat tax Las Vegas computation is that only one American layer touches them.

UK Rental Profits

A British expat in Las Vegas who lets a UK property pays UK tax through the non-resident landlord scheme. British nationals generally keep the UK personal allowance after leaving, which Americans without British nationality do not. Federally, Form 1116 relieves most of the American charge. Nevada adds nothing further, so this is one of the cleanest outcomes available anywhere in the United States.

Selling a UK Property

Britain taxes non-residents on gains from UK residential property, generally on growth since April 2015. Federally, the whole gain is taxable, with credit for the UK charge on the overlapping slice. In Minneapolis that same gain would also meet a 9.85% state charge plus a 1% surtax. Here it meets neither. Consequently, timing a UK disposal to fall in a Nevada year rather than a California or Oregon year can be worth six figures.

UK Pensions

A UK personal pension or SIPP drawdown is taxable federally, with the treaty deciding the UK side. Nevada does not tax pension income, because it does not tax income at all. Therefore a British retiree comparing Las Vegas with Atlanta or Philadelphia will find Nevada simpler and usually cheaper, even allowing for higher sales tax.

ISAs, Dividends and UK Funds

An ISA has no American equivalent, so its income is fully taxable federally. Similarly, UK funds are usually passive foreign investment companies. That status brings its own reporting and rate consequences. Those federal problems are unchanged by living in Nevada. Accordingly, the expat tax Las Vegas saving on this income is real but sits entirely at state level.

FBAR, Form 8938 and Missed Reporting

Any US person with foreign accounts above $10,000 in aggregate must file the FBAR with FinCEN. Separately, Form 8938 under FATCA applies at higher thresholds. Our FBAR and FATCA reporting service handles both. Where federal returns are late, the IRS operates the Streamlined Filing Compliance Procedures for taxpayers whose failures were not wilful.

Gambling Winnings in the City That Runs on Them

No expat tax Las Vegas guide is complete without this, and the rules changed for 2026.

Britain Taxes Winnings at Nothing

The United Kingdom does not tax gambling winnings as income or as capital gains. British arrivals therefore assume the same applies here. It does not. The United States taxes gambling winnings as ordinary income, and Nevada's lack of an income tax does nothing to change the federal position.

The 90% Loss Limit From 2026

This is the change that matters. Historically, gambling losses were deductible up to the amount of winnings. For tax years beginning after 31 December 2025, only 90% of losses may be deducted, still capped at winnings. Consequently, a player who wins $200,000 and loses the same amount now has taxable income. They broke even and still owe tax. That asymmetry is the single most important expat tax Las Vegas development for anyone who plays seriously.

Itemising, Thresholds and Reporting

Losses are deductible only if you itemise. That means giving up the standard deduction, which is $16,100 for single filers and $32,200 for couples in 2026. Furthermore, a separate limitation reduces the value of itemised deductions in the top bracket. That makes the expat tax Las Vegas arithmetic worse for high earners. Casinos report larger wins on Form W-2G. The reporting threshold for slot and bingo wins rises from $1,200 to $2,000 for 2026. Therefore careful session records matter more than ever.

The Quiet Advantage for British Winnings

Here is a point no competing page makes. Winnings from UK sources are foreign-source income in the general category for foreign tax credit purposes. Consequently, excess credits from UK salary or UK rental income can absorb the American tax on them. Meanwhile, the treaty exemption that protects non-resident gamblers is unavailable to US citizens because of the saving clause. Accordingly, the expat tax Las Vegas analysis differs sharply between a green card holder and a visa holder.

Gambling and Foreign Accounts

One further trap deserves a mention. In US v Hom, a court held that online poker site accounts were not themselves reportable foreign financial accounts, while a linked overseas e-wallet was. That distinction is narrow and the decision was unpublished. Therefore we treat offshore gaming balances conservatively and review them account by account.

Professional Players Face a Different Regime

A recreational player reports winnings as other income and deducts losses as an itemised deduction. Someone whose gambling amounts to a trade or business reports on Schedule C instead, deducting expenses such as travel and data services. However, the loss limitation still applies, and the new 90% restriction applies to both groups. Furthermore, Schedule C profits attract self-employment tax at 15.3% on the first tranche of earnings.

The Totalisation Point British Players Miss

That self-employment charge is where a British connection helps. Under the US-UK social security agreement, someone who remains within the UK system on a certificate of coverage is not liable to US self-employment tax on the same earnings. Consequently, a British professional player newly arrived in Nevada should check their social security position before filing a first Schedule C. In our experience, this is the most commonly missed expat tax Las Vegas item for self-employed arrivals.

The Records the IRS Expects

Gambling deductions fail on evidence far more often than on law. We ask clients to keep a contemporaneous log of dates, venues, machine or table numbers, stakes and results. It should reconcile to casino player-card statements and to every Form W-2G. Additionally, bank and card records should corroborate the cash movements. Therefore the log is built through the year rather than assembled in April.

Residency: Arriving From California, or From Britain

Nevada asks nothing of you. However, the state you left may ask a great deal, and that is where most expat tax Las Vegas savings are lost.

California Will Test Your Departure

Most of our Las Vegas clients arrive from California. That state taxes residents at rates reaching 13.3% and credits no foreign tax at all. The Franchise Tax Board examines departures closely. It looks at where your home, family, licences, vehicles and professional ties actually sit. Consequently, the saving is only secured if the move is genuine and documented. We build that evidence file at the point of the move.

Keeping the Old House Is the Classic Mistake

Retaining a California property that stays available to you is the fact pattern that most often defeats a departure claim. It undoes the expat tax Las Vegas saving entirely. The same applies to a Minnesota lake house or an Oregon home. Therefore an expat tax Las Vegas relocation plan deals with the former state's property before it deals with anything else.

Arriving Directly From the United Kingdom

Families moving straight from Britain face a simpler position. There is no prior state to satisfy, and Nevada requires no residency computation. However, the federal residency start date still governs the year of arrival. UK income received before that date is treated differently from income received after it. Accordingly, the arrival-year federal return still needs proper apportionment.

Nevada Is a Community Property State

Nevada is one of nine community property states, which shapes every expat tax Las Vegas return for a married couple. Income earned during marriage is generally owned half by each spouse. That matters where spouses file separately. Importantly, where one spouse is a nonresident alien, section 879 of the Internal Revenue Code overrides the community split for earned income. Consequently, mixed-nationality couples need that analysis before filing, exactly as they would in Texas.

Making the Move Work in Practice

The saving is won or lost in the months around the move, not on the return.

Time the Move Against Your UK Disposals

If you are going to sell a UK property or a large holding of UK shares, the year in which completion falls decides whether a high-tax state takes a slice. Selling while still resident in California, Oregon or Minnesota exposes the gain to that state. Completing after the move exposes it only to the federal system and to HMRC. Consequently, the expat tax Las Vegas calendar should be built before contracts are exchanged.

Deal With the Former State's Property

Your old state will look hardest at housing. Selling the previous home, or letting it on genuine arm's length terms, is far stronger than keeping it available for visits. Moreover, the argument is evidential rather than technical, so the file you build at the time is what decides it years later. Accordingly, we treat the former home as the first item on any expat tax Las Vegas relocation checklist.

Move the Ordinary Markers Promptly

Driving licence, vehicle registration, voter registration and bank accounts all form part of the picture. So do professional licences, medical practitioners and club memberships. None is decisive alone. Taken together and dated early, they make a departure difficult to challenge. Therefore we ask clients to complete them within the first weeks rather than the first year.

Check the Property Tax Cap at Purchase

The 3% and 8% caps attach to how a property is used. A family that buys early and lets the property briefly in the interim can find the classification hard to change afterwards. The Clark County Treasurer publishes the rates and the abatement position. Consequently, we raise the cap question at offer stage on every expat tax Las Vegas purchase.

Paying the Federal Bill Without Any Withholding

A state with no income tax removes a return. It does not remove the need to pay tax through the year.

Nobody Withholds on UK Income

Your Nevada employer withholds federal tax from your salary. Nothing is withheld from UK rental profit, UK dividends, UK pension drawdowns or gambling winnings outside the reportable thresholds. Consequently, a British household with substantial UK income can finish the year owing a large federal balance despite being fully employed. That gap is a recurring expat tax Las Vegas problem in the first full year after a move.

The Penalty Is for Timing, Not Non-Payment

Federal law charges an underpayment penalty where too little tax is paid across the year, even if the final bill is settled in full and on time. The charge is computed quarter by quarter, so paying everything in April does not cure an earlier shortfall. Therefore the remedy is to pay as the income arises, through quarterly estimates or by increasing withholding on the salary.

Why Increasing Withholding Often Beats Estimates

Withholding is treated as paid evenly across the year, whichever month it is actually deducted. Estimated payments are credited when made. Consequently, a household that discovers a shortfall in the autumn can often fix the whole year by raising payroll withholding, where four quarterly payments could not. We use that technique frequently in expat tax Las Vegas planning for salaried clients with UK investment income.

Build the Estimate From the UK Figures

The UK tax year ends on 5 April while the American year ends on 31 December, so the UK figures never map neatly onto a federal quarter. We apportion UK rental profit and pension income by month, apply the expected credit, and set the payment schedule from that. Accordingly, the estimate rests on documented arithmetic rather than a guess, which also supports the position if the computation is later queried.

Worked Case Study: A British Family Moving From San Francisco to Summerlin

Numbers make the expat tax Las Vegas position concrete. This composite case uses 2026 figures.

The Position Before the Move

Martin and Aisha are British nationals with green cards. Martin earns $600,000 running operations for a hospitality group. They let a Clapham flat producing UK profit of about $76,000, on which they pay roughly $20,000 of UK tax after the personal allowance. They also hold UK shares paying about $45,000 in dividends, on which Britain charges a non-resident nothing. Until this year they lived in San Francisco.

What the Move Saved

California taxed the whole of that UK income. It gave no credit for the $20,000 already paid to HMRC. At their marginal California rate, the UK rental profit and the UK dividends together cost roughly $12,500 a year in state tax alone. In Nevada that charge disappears entirely. Moreover, the dividends are the bigger win, because the foreign tax credit never sheltered them federally either.

Where They Still Lost Money

Two things went wrong. First, they bought a second Summerlin property to let and assumed the 3% property tax cap applied. As a non-owner-occupied rental it falls under the cap of up to 8%, so their projection understated the bill. Second, Martin had a heavy year at the tables. He won about $180,000 and lost about $200,000. Under the new 90% rule his deductible losses were capped at $162,000, not the full $180,000 of winnings. That left roughly $18,000 of taxable income in a year he finished down.

What Changed After Review

We corrected the property tax assumption in their cash-flow model and reviewed the cap classification on both homes. We also put a session log and a W-2G reconciliation in place, so the gambling figures are defensible rather than estimated. Finally, we documented the California departure properly. A successful Franchise Tax Board challenge would have undone the whole saving.

The Wider Lesson

The expat tax Las Vegas saving was real and immediate. The federal and UK positions did not change at all, and one federal rule change cost more than they expected. In our experience, families moving to Nevada bank the headline saving and stop looking, which is precisely when the remaining exposures grow.

How TaxYork Can Help

We prepare US and UK returns together for high-net-worth British and dual national families across the Las Vegas valley. Specifically, we model the federal and UK positions as one computation. We also document departures from high-tax states and review property tax cap classifications before purchase. Furthermore, we handle missed FBAR filings, missed US tax returns and unreported UK pension or investment accounts through the right catch-up route.

Our work covers annual expat tax Las Vegas compliance, foreign tax credit basket planning, treaty positions on UK pensions, non-resident landlord reporting and gambling substantiation for clients who play seriously. Our US tax return preparation service covers the federal filings. Professional guidance from the ICAEW and the Chartered Institute of Taxation informs how we document every position we take.

Conclusion

Nevada is the most straightforward state in this series for a British household. Its constitution forbids a personal income tax, so there is no state return, no state residency test and no argument about whether HMRC tax earns a credit. Consequently, UK dividends and ISA income, which most states tax with no relief whatsoever, escape state tax entirely.

However, the burden moves rather than vanishing. Sales tax runs at 8.375% in Clark County, let property sits under an 8% rather than a 3% tax cap, and the federal rules bite exactly as hard as anywhere else. From 2026, the 90% gambling loss limit can create taxable income for a player who broke even. Ultimately, the expat tax Las Vegas advantage is real, but it is a state-level advantage only. To summarise, bank the saving and then fix the federal return.

Frequently Asked Questions

No. The Nevada Constitution, at Article 10 section 1, prohibits any income tax on the wages or personal income of natural persons. Changing it would need approval by two consecutive legislatures and then a vote of the people, so the position is unusually durable.

No. Nevada taxes no personal income of any kind, whether it arises in Nevada, elsewhere in America or in Britain. Your UK rents and pensions remain taxable federally and, depending on the source and the treaty, in the United Kingdom.

Yes. The foreign tax credit relieves federal tax, not state tax, so it remains essential. Because no state return competes for the same income, the federal computation carries the entire expat tax Las Vegas outcome.

The combined rate in Clark County is 8.375% for 2026, consisting of the 4.6% state rate plus 3.775% of county and local additions. Nevada relies on consumption and property taxes in place of an income tax.

No. The 3% annual cap under NRS 361.4723 applies to an owner-occupied primary residence. Property that is let, along with land and commercial buildings, falls under a cap of up to 8%, so a British landlord should budget for faster increases.

Yes, for US persons. Britain taxes gambling winnings at nothing, but the United States taxes them as ordinary income regardless of Nevada having no income tax. Green card holders cannot use the treaty exemption available to some non-resident visitors.

For tax years beginning after 31 December 2025, only 90% of gambling losses are deductible, still capped at total winnings and available only if you itemise. A player who wins and loses the same amount therefore ends the year with taxable income.

It can, if it concludes you never genuinely left. The Franchise Tax Board examines where your home, family and ties remain, and keeping an available California property is the most common weakness. Document the move as it happens rather than afterwards.
