Introduction: Why Expat Tax Nashville Planning Is Not Zero-Tax Planning

The expat tax Nashville question looks simple, because Tennessee levies no personal income tax at all. However, that headline hides the bill that actually matters. The Internal Revenue Service still taxes every pound of your UK rent, pension, ISA income and currency gain, and in a no-tax state there is nothing at state level to cushion the result.

At TaxYork, we prepare returns for British healthcare executives, fund managers, music industry figures and company owners across Nashville, Green Hills, Belle Meade, Brentwood and Franklin. In our experience, the families who arrive expecting a tax-free life are the ones most likely to underpay the IRS in their first two years. Consequently, a sound expat tax Nashville plan starts with the federal return, not the state one.

Expat Tax Nashville Basics: One Missing Layer, Two Live Ones

A British household in Nashville deals with two live tax systems instead of three. First, federal income tax reaches worldwide income, softened by the foreign tax credit on IRS Form 1116. Second, the United Kingdom keeps taxing UK property, UK workdays and certain pensions. Tennessee simply drops out of the income tax picture. Therefore the expat tax Nashville computation is a two-country exercise, and every error lands directly on the federal line.

Who This Guide Is Written For

This guide addresses high-net-worth British nationals, dual national US UK families and accidental Americans living in Middle Tennessee. Specifically, it suits executives, investors and owners who keep London property, SIPPs, ISAs, sterling deposits and deferred UK bonuses. If your household income passes $300,000, every expat tax Nashville rule below carries a measurable price. For the national picture first, read our complete guide to UK expat tax in the USA.

How Nashville Compares With the Other Cities We Cover

Nashville belongs to the small group of no-income-tax destinations in our city series. Our Miami guide and our Texas guide cover the other two most popular with British families. By contrast, Seattle has no wage tax but charges a capital gains tax, as our Seattle guide explains. Meanwhile, North Carolina taxes UK income but credits UK tax. Accordingly, the expat tax Nashville position is the cleanest of all at state level, which makes the federal errors easier to see.

What Tennessee Taxes and What It Does Not

Tennessee raises its revenue from sales, property and business taxes rather than from individuals' income. Understanding that mix explains where an expat tax Nashville household still pays.

The Hall Tax Is Gone

Tennessee once taxed interest and dividends through the Hall income tax. The legislature phased it down and repealed it completely from 1 January 2021. Therefore UK dividends, ISA income, gilt interest and bank interest attract no Tennessee tax at all. Similarly, wages, bonuses, pensions and capital gains are outside the state's reach. For expat tax Nashville purposes, the state return you file as an individual is nil.

Sales Tax Is Now 9.75% in Nashville

Tennessee charges a 7% state sales tax, and Davidson County adds a local rate. Notably, Davidson County voters approved a transit surcharge in November 2024, lifting the local rate to 2.75% from 1 February 2025. The combined Nashville rate is therefore 9.75%, although several relocation guides still quote 9.25%. Importantly, the local tax applies only to the first $1,600 of a single article, and a separate 2.75% state single article tax covers the slice between $1,600 and $3,200, as the Tennessee Department of Revenue's single article guidance explains.

Property Tax in Davidson County

Residential property is assessed at 25% of appraised value, and commercial property at 40%. For 2025, the Davidson County Property Assessor lists a rate of $2.814 per $100 of assessed value in the Urban Services District. For example, a $2.4 million home in Green Hills carries an assessed value of $600,000 and an annual bill of about $16,884. Consequently, property tax is the largest state-level cost in most expat tax Nashville budgets we prepare.

The SALT Deduction Works Differently Here

Because you pay no state income tax, federal law lets you deduct general sales tax instead. You can use actual receipts or the IRS sales tax deduction calculator, adding tax on a car, boat or aircraft. However, the 2026 cap on state and local tax deductions is $40,400, and it phases down by 30 cents per dollar of income above $505,000, reaching a $10,000 floor. Additionally, property tax on a London flat is not deductible at all, because foreign real property taxes fell outside the deduction from 2018. For higher earners, the expat tax Nashville deduction is usually capped at $10,000.

The Federal Bill on Your UK Income

This is the section most arriving families underestimate. The absence of state tax changes nothing about how the IRS treats your UK income, and it removes any state credit that might have softened it.

Worldwide Income From Your Residency Start Date

Once you hold a green card, or you meet the IRS substantial presence test, you are a US tax resident. From that date, the IRS taxes your worldwide income at rates of up to 37%, plus 3.8% net investment income tax on investment income. Therefore UK rents, dividends, pension income and gains all reach Form 1040. For an expat tax Nashville household, the top combined federal rate on UK investment income is 40.8%.

The Foreign Tax Credit Only Covers the UK Share

The foreign tax credit gives you a dollar-for-dollar reduction for UK income tax paid on UK-source income. However, the credit is limited to the US tax on that same foreign income, category by category. Where the UK rate is lower than the US rate, the IRS collects the difference. For example, UK rent taxed by HMRC at 20% still owes a further 17% to the IRS at the top bracket. As a result, the expat tax Nashville bill on UK rental income is rarely zero.

Net Investment Income Tax Cannot Be Credited

The 3.8% net investment income tax under section 1411 sits outside the income tax chapter, so the foreign tax credit cannot reduce it. Furthermore, the Federal Circuit confirmed on 31 August 2026 that the US-UK treaty does not create a credit against it either. Consequently, every UK dividend, rent and gain carries at least 3.8% of uncreditable US tax. In expat tax Nashville planning, we treat that 3.8% as a fixed cost of holding UK assets.

UK Workdays and Deferred UK Bonuses

Many Nashville arrivals still travel to London or hold unvested UK bonuses. Under US sourcing rules, pay for days worked in Britain is foreign-source, so UK tax on it is creditable. Meanwhile, HMRC taxes the portion of a deferred bonus earned while you worked in the UK, even when it vests after you leave. Therefore a workday diary is essential, because it drives both the UK charge and the size of your credit. Without one, the expat tax Nashville return usually overpays on one side of the Atlantic.

UK Pensions, ISAs and Property From Nashville

The treaty allocates each UK asset differently. Consequently, the expat tax Nashville outcome depends on exactly which assets you brought with you.

Private UK Pensions and SIPPs

Under Article 17 of the US-UK income tax treaty, a private UK pension paid to a US resident is taxable only in the United States. You claim UK exemption through the forms listed on HMRC's USA tax treaties page. However, the 25% tax-free lump sum is a trap. Britain does not tax it, yet the treaty's saving clause lets the IRS tax its residents on it. Therefore a £250,000 lump sum can cost over $110,000 in federal tax, with no UK tax to credit and no Tennessee relief needed.

The UK State Pension

The UK State Pension paid to a Nashville resident is taxable only in the United States under Article 17(3). Importantly, IRS Publication 915 treats foreign social security as an annuity unless a treaty says otherwise, so the whole pension is taxable rather than 85%. Our guide to the UK State Pension for Britons in America covers the detail. For expat tax Nashville clients, Tennessee adds nothing on top.

ISAs and UK Funds

The IRS does not recognise an ISA, so dividends, interest and gains inside it are fully taxable on your federal return. Worse, most UK funds are passive foreign investment companies for US purposes, which brings punitive default rules and annual reporting. Since Britain charges no tax inside the ISA, there is no credit to offset. Accordingly, many expat tax Nashville clients restructure their ISA holdings in the year before arrival.

London Rental Property

HMRC continues to tax your London rental income after you leave. Letting agents withhold 20% under the Non-Resident Landlord Scheme unless you hold approval to receive rent gross. Furthermore, the UK introduces separate property income rates of 22%, 42% and 47% from 6 April 2027, and HMRC's technical note on the new property rates confirms the withholding rate rises to 22%. Our guide to stopping the 20% landlord withholding explains the application. As a British national, you usually keep the UK personal allowance, as GOV.UK's guidance on UK income while living abroad confirms.

The Sterling Conversion Trap When You Buy in Nashville

This is the issue we find on almost every first-year expat tax Nashville file, and no relocation guide mentions it. It arises the moment you convert sterling savings into dollars to buy your Nashville home.

Currency Gain Is Taxable Income

Under section 988 of the Internal Revenue Code, converting a foreign currency deposit into dollars can produce a taxable exchange gain. The gain equals the dollar value on conversion minus the dollar value when you acquired the sterling. For instance, sterling earned when the pound bought $1.25 and converted at $1.34 produces a gain of 9 cents on every pound. On £1.5 million, that is $135,000 of income the IRS expects to see.

Your Tax Home Makes It US-Source

Section 988 sources currency gain by the residence of the taxpayer, which for an individual means their tax home. A Briton living in London has foreign-source gain, which foreign tax credits can sometimes shelter. However, a Briton living in Nashville has US-source gain. Consequently, the expat tax Nashville household has no foreign-source income to absorb the charge.

HMRC Charges Nothing, So Nothing Is Credited

Britain does not tax gains on individuals' foreign currency bank accounts, as HMRC's Capital Gains Manual at CG78320 confirms. Therefore no UK tax exists to credit against the US charge. Our dedicated guide to foreign currency gains on GBP accounts sets out the calculation. For expat tax Nashville clients, the cure is timing: convert large sterling balances before your US residency start date wherever possible.

Tennessee Business Taxes for British Owners

Tennessee has no personal income tax, but it does tax business entities. This distinction matters for any British founder or investor who forms a local company, and it is the part of expat tax Nashville planning most often missed.

The Franchise and Excise Tax Reaches LLCs

Tennessee applies a 6.5% excise tax to the net earnings of most entities doing business in the state, including limited liability companies. Additionally, the franchise tax charges 0.25% of net worth, with a $100 minimum, according to the Department of Revenue's franchise tax computation note. Since 2024, the franchise tax is based on net worth alone, following repeal of the old property measure. Importantly, a single-member LLC ignored for federal purposes is still a taxable entity in Tennessee. Therefore a consultant who trades through an LLC pays 6.5% on profits that would carry no state tax as a sole proprietor.

The Family-Owned Investment Exemption

Tennessee exempts a family-owned non-corporate entity when at least 95% is family-owned and at least two thirds of its income is passive. The Department of Revenue's definition of passive investment income includes dividends, interest, securities gains and rents from residential property. Accordingly, a family LLC that holds a UK and US portfolio can often qualify. However, the exemption requires an annual application, and a missed filing exposes the entity to the full excise tax.

The Professional Privilege Tax on Securities Professionals

Tennessee charges a $400 annual professional privilege tax on certain licensed professionals, including securities agents, broker-dealers and investment advisers. The Department of Revenue's due date guidance confirms it falls due on 1 June each year. Notably, the charge attaches to an active Tennessee registration, not to residence. For a British wealth manager relocating to Nashville, it is a small but genuine expat tax Nashville cost.

Arrival Year, Residency and Missed Reporting

The arrival year produces most of the errors we correct. Getting it right protects every later expat tax Nashville return.

The Dual-Status Arrival Year

Most families are non-resident for part of the arrival year and resident for the rest. That creates a dual-status return, on which only income after the residency start date is taxed worldwide. Our guide to the dual-status tax year explains the mechanics. Alternatively, a first-year choice election can bring forward the start date where that helps. Therefore the timing of large UK disposals around the start date deserves careful thought.

The UK Side of Leaving

On the UK side, the statutory residence test guidance in RDR3 decides when you stop being UK resident. Split-year treatment can divide the departure year, so UK tax on post-departure foreign income falls away. However, if you return to the UK within five years, gains realised while abroad can be taxed on your return. Consequently, expat tax Nashville planning for a fixed-term secondment differs from planning for a permanent move.

FBAR and Form 8938 From Day One

As a US resident, you must report UK accounts, ISAs and many pensions. An FBAR is due to FinCEN when your foreign balances exceed $10,000 in aggregate at any time in the year. Additionally, Form 8938 applies to US residents above $50,000 at year end or $75,000 at any time for single filers, doubled for joint filers. Many expat tax Nashville clients miss both in their first year.

Correcting Missed Years

If you have already missed returns, FBARs or information forms, a non-wilful failure can usually be corrected. Residents in the United States generally use the domestic version of the IRS Streamlined Filing Compliance Procedures, which carries a 5% penalty on the highest year-end balance of the unreported assets. Therefore earlier correction is almost always cheaper. Our FBAR and FATCA compliance service handles the full catch-up.

Worked Case Study: A British Healthcare Executive in Green Hills

This illustrative case shows how the expat tax Nashville numbers work in practice. The figures are rounded and based on a composite of files we have prepared.

The Position Before Review

Richard, a British national, moved to Nashville in 2025 as chief operating officer of a healthcare group, holding a green card with his wife Sarah. His US salary was $650,000. They kept a London flat producing net UK rental profit of £40,000, an ISA of £400,000, and £1.5 million of sterling savings, which they converted in 2026 to buy a $2.4 million home in Green Hills. Their previous preparer filed a federal return showing only the US salary, on the basis that Tennessee does not tax income.

What the IRS Was Owed

After allowing depreciation, the US rental profit was about $42,000, taxed at 37% to give $15,540. The UK tax on the flat was £5,486, or about $7,240, which the foreign tax credit applied against that $15,540. Therefore the residual federal tax on the rent was about $8,300, plus $1,600 of net investment income tax. The ISA produced about $16,000 of dividends and gains, taxed at ordinary rates under the fund rules for about $6,500 federally, with no UK tax to credit. Finally, the sterling conversion produced a $135,000 currency gain, which we reported as ordinary income at 37%, costing about $49,950.

What Changed After Review

We filed amended returns and corrected the missed FBARs and Forms 8938 under the domestic Streamlined procedure, reporting all UK income properly. Additionally, we applied for gross rent approval in the UK and restructured the ISA holdings. The expat tax Nashville correction cost them about $66,000 in tax plus interest, but it removed exposure to far larger information return penalties.

The Road Not Taken

Had Richard and Sarah converted their sterling before their residency start date in 2025, the $49,950 currency charge would very likely never have arisen. Similarly, a pre-arrival review of the ISA would have avoided two years of fund reporting. Ultimately, the most valuable expat tax Nashville advice is given before the removal van arrives, not after the first IRS letter.

How TaxYork Can Help

TaxYork provides comprehensive US and UK tax return preparation for British families and dual nationals living in Nashville and across Tennessee. We prepare the federal return, including dual-status and first-year returns, foreign tax credit computations and treaty positions. Furthermore, we prepare your UK Self Assessment return for UK rents, UK workdays and departure-year split-year claims.

Our US tax returns for expats service covers every federal form a UK-connected household needs, from Form 1116 to Form 8938. Additionally, our cross-border planning service handles pre-arrival sterling, ISA and pension timing. Because one team prepares both sides, your expat tax Nashville filings stay consistent year after year.

Conclusion

Tennessee's lack of an income tax is real, and for a British family it removes an entire layer of compliance. However, it does nothing to reduce the federal tax on UK rents, pensions, ISA income and sterling conversions. In fact, it makes federal errors more expensive, because no state credit or deduction softens them.

In summary, a well-run expat tax Nashville plan converts sterling before arrival, uses the treaty correctly for pensions, claims every available foreign tax credit and files FBAR and Form 8938 from the first year. Above all, it treats the federal return, not the state one, as the main event. Professional bodies such as the ICAEW tax faculty and the Chartered Institute of Taxation publish useful background on both systems.

Frequently Asked Questions

No. Tennessee levies no tax on wages, pensions, capital gains, dividends or interest. The Hall tax on investment income was fully repealed from 1 January 2021. Tennessee does, however, tax business entities such as LLCs through its 6.5% excise tax and its franchise tax on net worth.

Yes. As a US tax resident you pay federal tax on worldwide income, including UK rent, dividends, pensions and gains. The foreign tax credit reduces the bill by UK tax paid, but only up to the US tax on that income, and the 3.8% net investment income tax cannot be credited.

A private UK pension paid to a US resident is taxable only in the United States under the treaty, so the IRS taxes it and Tennessee does not. The 25% tax-free lump sum is still taxable federally. The UK State Pension is also taxable only in the US, in full.

Nashville's combined sales tax rate is 9.75%, made up of Tennessee's 7% state rate and Davidson County's 2.75% local rate, which took effect on 1 February 2025. The local portion applies only to the first $1,600 of a single item, with a 2.75% state single article tax between $1,600 and $3,200.

Yes, if you are a US tax resident and your UK accounts, ISAs and certain pensions exceed $10,000 in aggregate at any time in the year. Form 8938 may also apply above $50,000 for single filers. Expat tax Nashville clients often miss both in their arrival year.

It can be. Under section 988, converting sterling deposits into dollars can produce a taxable exchange gain, and for a Nashville resident that gain is US-source. Britain does not tax it, so there is no UK tax to credit. Converting before your US residency start date usually avoids the issue.

Usually yes. Tennessee charges LLCs a 6.5% excise tax on net earnings and a 0.25% franchise tax on net worth, with a $100 minimum, even when the LLC is disregarded federally. A family-owned LLC earning mainly passive investment income may qualify for exemption if it applies each year.

It removes state income tax, which saves significant sums compared with New York or California. However, the federal tax on UK income is unchanged, and property and sales taxes are material. Expat tax Nashville planning works best when sterling, ISA and pension decisions are made before arrival.
