IRS Letter 5071C response: leather document wallet, envelope and pen on a walnut desk in a London study

An IRS Letter 5071C posted to a London address can lose half of its 30-day response window in transit, so verifying your identity quickly keeps your US return moving.

Introduction: What IRS Letter 5071C Means for Americans in Britain

IRS Letter 5071C is a posted notice telling you that the IRS has stopped processing a Form 1040 filed under your Social Security number until you prove you are the person who filed it. For an American living in London, that letter usually arrives late, uses a verification system built around US documents, and freezes a return that often carries a large refund, foreign tax credit carryovers and an overpayment you planned to apply to next year's tax. Consequently, a routine fraud check can become an expensive problem if you handle it slowly.

At TaxYork we prepare US and UK returns for investment bankers, fund partners and company owners, and every filing season some of those returns are caught by the identity filters. In our experience, the clients who resolve IRS Letter 5071C fastest are those who know which letter they hold, which route works from Britain, and which documents the IRS will test them on. Accordingly, this guide covers all three, and then explains the cross-border knock-on effects that general guides ignore.

IRS Letter 5071C in One Paragraph

In short, IRS Letter 5071C is not an audit, a bill or a finding of fraud. Instead, it is an identity check issued by the IRS Taxpayer Protection Program, which screens returns for signs that a criminal has filed using a stolen identity. The IRS explanation of the CP5071 series confirms that the series includes CP5071, Letter 5071C and CP5071F, and that verifying lets the IRS continue processing your return. Until you respond, nothing moves.

Why the Letter Matters More When You Live Abroad

For a domestic filer, IRS Letter 5071C is an irritation. For you, it is a timetable problem. The Taxpayer Advocate Service page on responding to Letter 5071C states that you should respond within 30 days of the date printed on IRS Letter 5071C, not the date it reaches you. International post from the United States often takes ten days to three weeks, so a meaningful part of your window can disappear before you open the envelope. Furthermore, the telephone route runs on US business hours, and the online route was designed for American driving licences and American mobile numbers.

Why the IRS Holds Returns Filed From Britain

The IRS does not publish its fraud filters, for obvious reasons. Nevertheless, the patterns are well understood among practitioners, and wealthy Americans abroad trip them far more often than the average filer. Therefore, understanding the triggers helps you predict a letter before it arrives.

The Taxpayer Protection Program Filters

The program compares each incoming return with your filing history and with third-party information. Specifically, it looks for returns that differ sharply from earlier years, that claim an unusually large refund, or that arrive earlier than you normally file. An IRS tax tip on suspected identity theft letters confirms that the IRS will not process the suspicious return until the taxpayer responds. Importantly, a held return has still been received; the hold simply stops the IRS from acting on it.

Triggers Common Among High Earners in London

Several features of a typical cross-border return look unusual to an automated filter. For example, your first return after moving from New York carries a British address, a new preparer and a new bank. Additionally, a vesting year for restricted stock, a carried interest distribution or a business sale can triple your reported income in a single year. Moreover, a large foreign tax credit can turn a return that previously showed a balance due into one claiming a five-figure refund.

Similarly, filing several years at once is a classic trigger. When we bring clients up to date on missed US tax returns, three or four Forms 1040 arrive within days of each other, each with a foreign address and each showing years of income the IRS has never seen. In that situation, each year can draw its own letter, and each needs its own verification.

When Someone Else Filed in Your Name

Occasionally the filter is right. Senior executives and company owners appear in data breaches like everyone else, and their Social Security numbers are valuable. If you did not file the return named in IRS Letter 5071C, the IRS guidance says you should tell it so through the same verification service or telephone line. In that case, you are dealing with identity theft rather than a routine check, and the remedy changes: your genuine return may need to go on paper, and you should apply for an Identity Protection PIN as soon as the account is cleared.

Which Letter Did You Receive? 5071C, 5447C, 4883C and 5747C

The IRS uses a family of letters for the same purpose, and the number in the top corner decides how you may respond. Consequently, reading the letter number carefully is the first practical step when you suspect you hold an IRS Letter 5071C. Many clients assume every identity letter is an IRS Letter 5071C, which leads them to the wrong route.

The CP5071 Family and the Overseas Letter 5447C

IRS Letter 5071C and its CP5071 relatives allow online verification. Letter 5447C, by contrast, is the version the IRS describes as relating to potential identity theft "outside the U.S." In practice, a return showing a British address may produce Letter 5447C rather than IRS Letter 5071C, although the two are handled in the same way. The IRS Identity and Tax Return Verification Service states that the online service is only for CP5071 series notices and Letter 5447C. Accordingly, either letter lets you verify online if you can sign in.

Phone-Only and In-Person Letters

Letter 4883C, on the other hand, requires you to telephone the IRS; it does not offer the online service. Letter 5747C goes further and requires an in-person appointment at a Taxpayer Assistance Center in the United States. For a resident of Britain, a 5747C is the most disruptive version, because it assumes you can attend an office. In those cases, we usually time the appointment with a planned US trip, or we ask the IRS whether a telephone alternative is available given your foreign residence.

Checking the Letter Is Genuine

Fraudsters copy IRS letters, so you should verify before you respond. Genuine identity letters arrive by post, never by email, text message or social media. Moreover, type irs.gov into your browser yourself rather than following any link, and treat a letter that asks for payment or bank details as suspect, because a genuine identity letter asks only for verification. If you receive an email or text that claims to be from the IRS or HMRC, the UK government's guidance on reporting suspicious emails and phishing explains how to forward it safely.

How to Respond to IRS Letter 5071C From the UK

You have three possible routes: online, by telephone and, rarely, in person. For most of our clients, the online route works best, provided the IRS sign-in accepts your documents. Otherwise, the telephone route remains reliable if you prepare properly.

The Online Verification Service

The online route starts at irs.gov/verifyreturn, where you sign in to an IRS account and answer questions about the return named in IRS Letter 5071C. The IRS page on creating an account confirms that people living outside the United States with a Social Security number can create an account and verify their identity. Typically, you enter the 14-digit control number from IRS Letter 5071C, confirm details from the held return, and answer questions drawn from your prior-year filing. Once you finish, the IRS releases the return for processing.

When Online Verification Fails With UK Documents

Problems arise at the sign-in stage rather than at the return questions. For example, a UK driving licence is not a US state document, a British mobile number may not receive verification codes, and an expired US passport cannot serve as your primary photo identification. In our experience, a valid US passport plus a video call with the IRS's third-party identity provider is the most dependable combination from London. We cover this in detail in our guide to IRS identity verification without a US phone number, which sets out the international pathway step by step.

Verifying by Telephone From London

If online sign-in fails, call the identity verification number printed on your letter. That line handles identity and return verification only, so the agent cannot discuss refunds or other account matters on the same call. Importantly, the line runs on US Eastern hours, so plan to call in the British afternoon or early evening. If you have general account questions instead, the IRS international contact page lists the international taxpayer service line on 267-941-1000, which is not toll-free and opens Monday to Friday from 6am to 11pm Eastern time.

Documents to Have on the Desk

The IRS will test whether you know the contents of the return. Therefore, have the held return open in full, including every schedule and form, plus your prior-year return and its supporting documents. For a cross-border filer, that means your Form 2555 or Form 1116, your Form 8938, and any Schedule B detail on UK interest and dividends. Additionally, keep IRS Letter 5071C itself to hand, because the agent will ask for the control number. A Form W-2 or 1099 alone is not enough, as the IRS reminds callers that an information return is not a tax return.

What Happens After You Verify

Verification restarts processing, but it does not finish it. Consequently, you should plan around a further delay and check that the IRS has done what you expected once processing completes.

The Nine-Week Processing Window

The IRS verification service page says you should wait two to three weeks after verifying before checking on a refund, and that processing can take up to nine weeks. Meanwhile, the identity line cannot give you refund status. During that period, you can follow progress through your online account or through the IRS refunds hub. If nine weeks pass without movement, the account usually has a second issue, such as a mismatch with a Form 1099 or a question about a credit.

Refunds, Interest and Overpayments Applied Forward

A held refund can be large for our clients, because UK tax paid through PAYE often exceeds the US liability on the same income. Under section 6611 of the Internal Revenue Code, the IRS pays no interest on a refund issued within 45 days of the later of the due date or the date you filed. After that, interest generally runs at the federal overpayment rate. Furthermore, the Taxpayer Advocate guidance confirms that the hold also blocks an overpayment you elected to apply to next year's estimated tax. Therefore, if your 2026 estimated payment plan assumed that credit, check your account once processing completes, and use our guide to estimated taxes for Americans abroad to confirm whether section 6654 exposure remains.

If You Miss the 30-Day Window

Missing the date printed on IRS Letter 5071C does not usually close the door. In practice, the IRS can still verify you after 30 days, but your return stays frozen while you wait, and a long-unverified return may eventually generate further correspondence. Accordingly, respond as soon as you can, keep a record of every attempt, and escalate if the system fails you. Our guide to the Taxpayer Advocate Service for Americans in Britain explains when a case qualifies for help on the grounds of financial hardship or systemic delay.

The Cross-Border Knock-On Effects of IRS Letter 5071C

General guides stop once the refund arrives. However, a held return affects more than one form for an American in Britain, and the cross-border consequences are where real money is lost.

FBAR and Form 8938 Keep Their Own Deadlines

Your FBAR is not part of the return. You file it with FinCEN through its own system, as the FinCEN guidance on reporting foreign bank and financial accounts explains, and an identity hold on your Form 1040 does nothing to extend it. By contrast, Form 8938 travels with the return, so it is received on time even while the return is frozen. The IRS comparison of Form 8938 and FBAR requirements sets out how the two overlap. In short, never delay an FBAR because a letter has arrived about the return. Our FBAR and FATCA reporting service keeps the two filings on separate tracks for exactly this reason.

Foreign Tax Credit Carryovers and Treaty Positions

A frozen return also freezes the numbers that feed next year. For instance, excess UK tax carried forward on Form 1116 does not appear on IRS records until the return posts, and a treaty position disclosed on Form 8833 sits unread. Similarly, a first-year foreign earned income exclusion election made on Form 2555 is attached to a return the IRS has not yet accepted. None of these is lost through the hold. Nevertheless, you should confirm, once processing finishes, that the IRS posted the return as filed rather than as amended or partially processed. Where treaty relief is complex, our tax treaty optimisation work includes that confirmation.

Catching Up Missed US Tax Returns Without Triggering Holds

If you are behind on filing, you should expect at least one identity letter, and often an IRS Letter 5071C. Therefore, we stage catch-up filings deliberately: we verify the client's online account first, retrieve transcripts to confirm what the IRS already holds, and file years in a predictable sequence. Our guide to IRS wage and income transcripts shows how that groundwork works. Where a fuller programme is needed, our IRS Streamlined Filing service prepares the whole package, and we warn clients in advance that an IRS Letter 5071C on one of the years is normal rather than alarming.

Case Study: A London Managing Director and a Held 2025 Return

This illustrative case study combines features we see regularly. The names and figures are representative rather than taken from a single client.

The Position

Daniel is a US citizen and a managing director at a London investment bank. He moved from New York in mid-2025, so his 2025 Form 1040 was his first with a British address. His 2025 income was $1.2 million, including $410,000 of restricted stock that vested after the move, and UK PAYE withheld substantially more than his US liability on the post-move salary. As a result, the return claimed a refund of $38,600 and elected to apply a further $52,000 overpayment to his 2026 estimated tax.

We e-filed the return on 2 March 2026. On 18 March, the IRS dated an IRS Letter 5071C; it reached Daniel's flat in Kensington on 3 April, sixteen days later. Consequently, only fourteen days of the 30-day window remained when he opened it.

What We Did

Daniel first tried the online route, but his US passport had expired in 2025, and the sign-in rejected his UK driving licence. Rather than wait for a new passport, we prepared a verification pack the same afternoon: the full 2025 return, his 2024 New York-based return, his final US Form W-2, the Form 1116 workings and his Form 8938. He then called the verification number at 3pm London time, which was 10am Eastern, and completed verification in a single call. Meanwhile, we filed his FBAR separately well before the 15 April due date, so it never depended on the held return.

The Outcome

The return posted seven weeks later. The $38,600 refund arrived within the nine-week window, and the $52,000 credit appeared on his 2026 account, so his June estimated payment was correctly sized. Had he missed the window, the credit would have remained invisible while his 2026 payments fell due, and he would have faced a choice between paying twice or risking a section 6654 penalty. Finally, we applied for an Identity Protection PIN for him once the account was clear, so his 2026 return should pass the filters without a repeat.

Preventing a Repeat: The IP PIN and Clean Filing Habits

You cannot switch off the Taxpayer Protection Program. However, you can make your returns far less likely to be held, and far easier to verify when they are.

The Identity Protection PIN

An Identity Protection PIN is a six-digit number that the IRS issues each year and that must appear on your return. The IRS page on getting an Identity Protection PIN explains that the fastest route is through your online account. Importantly, the alternative Form 15227 application route carries an income ceiling that excludes most of our clients, so the online account is effectively the only route from Britain. Once enrolled, a return filed without the correct PIN is rejected, which protects you against a fraudster as well as reducing holds on genuine returns. Our guide to the IRS online account for Americans in Britain covers the set-up.

Consistency Between Years

Filters react to change. Therefore, keep your name, address format and filing pattern consistent from year to year. Additionally, file at a similar point each season, keep the same preparer where possible, and tell your preparer about large one-off income in advance so that the return explains itself. Furthermore, a client who files from Britain should keep both the current and prior-year returns in a single secure file, because those are the documents every verification route tests.

Authorising Your Preparer

A representative can help with verification, but the Taxpayer Advocate guidance says you must be on the call or present unless a Form 2848 power of attorney is on file. Accordingly, we often put a Form 2848 in place for clients with complex or multi-year filings. That lets us handle IRS correspondence, while you still complete the identity element personally. For a wider overview of living abroad as a US filer, the IRS guidance for US citizens and resident aliens abroad is a useful starting point.

How TaxYork Can Help

We provide comprehensive US and UK tax return preparation for Americans in Britain, including the correspondence that follows filing. When an IRS Letter 5071C arrives, we identify the letter type, assemble the exact documents the IRS will test, and prepare you for the online or telephone route on the same day.

Return Preparation That Anticipates the Filters

Our US tax returns for expats service prepares Forms 1040, 1116, 2555, 8938 and 8833 alongside your UK Self Assessment, so both returns use the same figures. Furthermore, we file FBARs on a separate timetable, so an identity hold never touches FinCEN reporting. If you have also fallen behind in Britain, our guide to missed UK tax returns for Americans explains how we bring both sides up to date together.

Follow-Through After Verification

Verification is the start of the process, not the end. Therefore, we monitor your account transcript until the return posts, confirm that refunds and applied overpayments appear, and check that foreign tax credit carryovers are recorded correctly. If processing stalls, we escalate. Throughout, our cross-border planning team coordinates the timing of large income events, so the next return is easier to process.

Conclusion

IRS Letter 5071C is an identity check, not an accusation, but for an American in Britain it can freeze a refund, an overpayment credit and the records that next year's return depends on. The 30-day window on IRS Letter 5071C starts on the letter date, the post eats into it, and the online route often fails with UK documents. Consequently, the best response is fast and prepared: identify the letter number, gather the held and prior-year returns, verify online with a valid US passport or call during the British afternoon, and keep your FBAR on its own timetable.

Above all, use the experience to prevent a repeat. An Identity Protection PIN, consistent filing habits and a preparer who understands both systems will make your next return far less likely to be held. If a letter has arrived, act this week rather than next month.

Frequently Asked Questions

Usually not, but you should check. A genuine IRS Letter 5071C arrives by post, never by email or text. Verify only through irs.gov or the telephone number the IRS publishes. If the online service recognises the control number on your letter, the letter is genuine. If you are unsure, call the IRS directly before responding.

The Taxpayer Advocate Service says you should respond to IRS Letter 5071C within 30 days of the date printed on it. That clock starts on the letter date, not on delivery, so post to Britain can consume half of it. The IRS can usually still verify you later, but your return remains frozen until you do.

The IRS says to wait two to three weeks before checking a refund, and that processing can take up to nine weeks after verification. Identity line agents cannot give refund status. If nothing has moved after nine weeks, there is usually a second issue on the account, which a transcript review normally reveals.

Yes. The IRS confirms that people living abroad with a Social Security number can create an online account and verify there. A valid US passport is the most reliable document. If online sign-in fails, call the number on your letter during US Eastern business hours, which falls in the British afternoon and evening.

Both ask you to verify your identity before the IRS processes a return, and both allow online verification. Letter 5447C is the version the IRS describes as relating to potential identity theft outside the United States, so it often reaches filers with foreign addresses. The documents you need and the response steps are the same.

The filters flag returns that differ sharply from your history, such as a new foreign address, a new preparer, a large income spike or an unexpectedly large refund. Filing several overdue years together also triggers checks. Receiving IRS Letter 5071C does not mean the IRS suspects you personally of anything improper.

No. Your FBAR is filed separately with FinCEN and has its own deadline, so an identity hold on your Form 1040 neither extends nor satisfies it. File the FBAR on time regardless. Form 8938, by contrast, is attached to the return, so it counts as received even while the IRS holds the return.

Not entirely. A representative can assist, but you must be on the call or present unless a Form 2848 power of attorney is on file. Even then, the identity questions are personal to you. In practice, your preparer assembles the documents and briefs you, and you complete the verification yourself.
