How Utah Taxes High Earners in 2026

Utah is one of a handful of states with a genuinely flat income tax. Nevertheless, the structure has quirks that change the result for wealthy British households, and most online summaries skip them.

The Expat Tax Utah Flat Rate After Six Years of Cuts

Utah lawmakers passed Senate Bill 60 in the 2026 session, cutting the rate from 4.5% to 4.45% with effect from 1 January 2026. This follows the 2025 cut from 4.55% to 4.5%, which means Utah has now reduced its rate for six years in a row. Importantly, for expat tax Utah purposes the same rate applies to salary, dividends, interest, rent, pensions and capital gains. Utah has no preferential capital gains rate, so a large UK share gain pays the full 4.45%.

The Taxpayer Tax Credit Disappears for High Earners

Utah does not use brackets or a standard deduction in the normal way. Instead, it gives a taxpayer tax credit equal to 6% of your dependant exemptions and your federal deduction. However, that credit phases out by 1.3% of income above a base amount, which was $36,426 for married couples filing jointly on the 2025 TC-40 instructions. As a result, a household with income of a few hundred thousand dollars loses the credit completely. In practice, therefore, the expat tax Utah charge for a wealthy family is simply 4.45% of almost all federal adjusted gross income.

No Local Income Tax Anywhere in Utah

Unlike Maryland, Pennsylvania or Oregon, Utah lets no city or county levy its own income tax. Consequently, a family in Park City pays the same expat tax Utah rate as one in downtown Salt Lake City. Property tax and sales tax still vary by location, but your income tax bill does not depend on your postcode.

The Federal Deduction for Utah Tax

Utah tax is deductible federally as state and local tax, but only within the SALT cap. For 2026, that cap is $40,400, yet it shrinks by 30% of modified adjusted gross income above $505,000 until it reaches a floor of $10,000. Accordingly, many of our Salt Lake City clients recover only a small part of their expat tax Utah bill through the federal deduction.

Why Utah Gives No Credit for UK Tax

This is the central expat tax Utah problem. The federal system relieves double taxation through the foreign tax credit, but none of that relief flows through to Utah.

The Credit Covers Other States Only

Utah's credit for tax paid elsewhere, claimed with code 17 on form TC-40A, is written in Utah Code section 59-10-1003. The statute limits it to tax imposed by another state of the United States, the District of Columbia or a US possession. Furthermore, the Utah State Tax Commission states on its guidance for residents and expatriates that there is no Utah credit for taxes paid to another country. Therefore, UK income tax, UK capital gains tax and non-resident landlord tax all count for nothing in the expat tax Utah calculation.

Why the Federal Credit Does Not Flow Through

The expat tax Utah calculation starts from federal adjusted gross income. The foreign tax credit, however, reduces federal tax after income is calculated, so it never touches that starting figure. In other words, a UK rental profit that the federal credit wipes out still arrives on your Utah return in full. The Commission even warns that if you choose the federal credit instead of an exclusion or deduction, you lose the tax benefit on your Utah return.

What Does Reduce Expat Tax Utah: Treaty Exclusions and the FEIE

Some federal reliefs do reduce Utah tax, because they keep income out of federal adjusted gross income altogether. For example, the untaxed growth inside a UK pension is not reported federally under the US-UK tax treaty, so Utah has nothing to tax. Similarly, the Commission confirms that income excluded under the foreign earned income exclusion stays excluded for Utah, with no add-back. That difference matters enormously for Utah-domiciled Americans working in London, as we explain below.

UK Pensions, the State Pension and Utah's Retirement Credits

British retirees and senior professionals often hold large SIPPs, workplace pensions and final salary schemes. Unfortunately, the expat tax Utah rules treat them less generously than many other states.

SIPP and Workplace Pension Drawdowns

Under Article 17 of the treaty, a UK pension paid to a US resident is taxable only in the United States, so HMRC can issue an NT code and pay you gross. However, the federal return then taxes the drawdown under the IRS rules on foreign pension distributions, and Utah taxes the same amount at 4.45%. The 25% tax-free lump sum is a particular trap, because the treaty's saving clause lets America tax its own residents on it. As a result, a £200,000 lump sum can add about $11,700 to your expat tax Utah bill at an illustrative $1.32 exchange rate.

The UK State Pension Misses the Social Security Credit

Utah offers a Social Security benefits credit that offsets tax on US Social Security. However, the UK State Pension is not reported as US Social Security on your federal return; it is 100% taxable pension income. Consequently, the Utah credit does not reach it, and your full UK State Pension falls into the expat tax Utah charge at 4.45%.

The Retirement Credit Is Closed to Most Newcomers

Utah's retirement credit of up to $450 per person applies only if you were born on or before 31 December 1952, according to the Utah guidance for retirees and seniors. Moreover, you cannot claim it alongside the Social Security credit. For most British families moving to Salt Lake City today, therefore, no expat tax Utah relief exists for UK pension income at all.

How Each Type of UK Income Fares in Utah

UK Rental Income

Britain keeps first right to tax UK rent, and a US resident usually pays UK tax through self assessment or the non-resident landlord scheme. You can read HMRC's rules on UK tax on rental income when you live abroad. Federally, the UK tax is credited against US tax on the same rent. The expat tax Utah charge, however, hits the full net rent again at 4.45%, with no credit. Furthermore, US depreciation rules differ from UK rules, so the US net rent figure often exceeds the UK one.

UK Share and Property Gains

A UK resident's shares become US-taxable the moment the owner becomes a US resident, and there is no step-up in basis on arrival. Consequently, gains built up over decades in London become fully taxable in Salt Lake City at federal rates plus the 4.45% expat tax Utah rate. UK residential property is different, because HMRC still taxes non-residents on UK land gains. In that case, the federal credit absorbs much of the double charge, but Utah's 4.45% remains a pure extra cost.

Temporary Non-Residence Can Reopen UK Tax

If you left Britain within the last five years and return within five full years, HMRC can tax gains on assets you owned when you left. The rule sits alongside the statutory residence test guidance. Therefore, a gain taxed in Utah during a three-year posting can later face UK tax as well, and Utah will never credit it.

ISAs and UK Funds

An ISA is invisible to the IRS as a tax wrapper, so its income and gains are fully taxable federally and in Utah. In addition, UK funds inside an ISA are usually passive foreign investment companies, which creates punitive federal reporting. Utah Domicile: The Trap for Americans in London

Utah's residency rules are unusually detailed, and domicile is where the expat tax Utah rules reach furthest. They matter for two groups: Britons arriving in Utah and Utah-connected Americans who move to London but never properly leave.

The Two Domicile Tests

The Utah domicile rules contain two tests. Under the first, you are domiciled in Utah if you or your spouse claim the federal child tax credit for a child enrolled in a Utah public school, enrol as a resident student at a Utah state university, or vote in Utah without registering elsewhere. Under the second, the Commission weighs a long list of factors, including a Utah home you intend to return to, a Utah driving licence, the residential property tax exemption and 183 days of presence. Notably, the first test is mechanical, so one absentee ballot can make you domiciled.

Domicile Follows You to London

A Utah-domiciled American who takes a London role remains inside the expat tax Utah net on worldwide income. For instance, a banker earning $400,000 in London who keeps the family home in Holladay and votes absentee in Utah owes about $17,800 a year to Utah. If that banker claims the federal foreign tax credit, none of the UK tax reduces the Utah bill. Over a three-year posting, the unfiled Utah liability can exceed $53,000 before interest and penalties.

The 761-Day Escape Route

Utah offers a statutory way out. You are not domiciled in Utah if you are absent for at least 761 consecutive days, return for no more than 30 days in any calendar year, and cut ties such as Utah school enrolment, the residential property exemption and Utah voting. However, the Tax Commission applies the conditions strictly, and its published appeal decisions show taxpayers failing on a single missed condition. Therefore, we plan the departure calendar before a client boards the plane, not after.

Why the Foreign Earned Income Exclusion Matters Here

For a Utah-domiciled American in London, the choice between the exclusion and the credit now has an expat tax Utah dimension. The 2026 exclusion of $132,900 removes that salary from both federal and Utah income. By contrast, the credit shelters it federally but leaves all of it taxable in Utah. Consequently, the exclusion can save about $5,900 of Utah tax each year, although it can raise federal tax through stacking and a five-year lock-out if revoked. Arrival and Departure Years in Utah

The expat tax Utah bill in your move year depends on dates, and federal, Utah and UK residency dates rarely match.

Part-Year Resident Returns

A part-year resident files form TC-40 with schedule TC-40B. Utah taxes all income received while you were resident, wherever it arises, and only Utah-source income for the rest of the year. Accordingly, the date you become a Utah resident decides whether a UK bonus, a share sale or a pension lump sum lands inside the expat tax Utah net.

Federal and UK Dates Differ

Federally, a British national usually becomes a resident alien under the substantial presence test from the first day of presence in the arrival year. In Britain, split-year treatment may end UK residence on the day you leave. Utah, meanwhile, looks at domicile and intent. Therefore, a single house sale or bonus payment can fall inside two or even three systems unless the dates are planned.

Case Study: The Pembertons in Holladay

This illustrative case study shows how the expat tax Utah rules combine for a real-world family. The names are invented, but the numbers reflect the patterns we see every season.

The Facts

Oliver Pemberton is an accidental American: born in London to an American mother, he has always been a US citizen but lived in Britain until 2025. His wife Hannah is British only. They moved to Holladay, a suburb of Salt Lake City, on 1 September 2025, when Oliver joined a Utah technology company. In 2026, Oliver earns $460,000 of salary and vested restricted stock units. The couple also keep their London flat, which produces net rent of £36,000, and Oliver draws £30,000 from his SIPP. Finally, in March 2026 Hannah sells her UK share portfolio for a gain of £250,000. We use an illustrative rate of $1.32 to the pound.

The Utah Bill

Their federal adjusted gross income is $877,120: salary of $460,000, rent of $47,520, SIPP income of $39,600 and Hannah's gain of $330,000. The taxpayer tax credit phases out completely, because 1.3% of their income above the base amount exceeds $10,900. Their expat tax Utah bill is therefore about $39,030 at 4.45%. Of that sum, $18,560 relates purely to UK income, and Utah gives no credit for the £4,686 of UK tax on the rent.

The Federal and UK Position

Federally, the UK rent tax is credited on Form 1116, and the SIPP drawing pays no UK tax under the treaty. Hannah's gain pays 20% federal tax plus the 3.8% net investment income tax, which is $78,540 or about £59,500. In addition, Utah adds $14,685 on the gain. What Timing Would Have Changed

Had Hannah sold in August 2025, while still UK resident and a US non-resident alien, she would have paid UK capital gains tax of 24% on the gain above the £3,000 annual exempt amount, which is £59,280. She would have paid no federal or Utah tax at all. Strikingly, the federal charge alone almost exactly matches the UK charge; Utah's 4.45% is the entire difference. Therefore, a sale six weeks earlier would have saved £11,345. We now review every British family's share portfolio before the flight to Salt Lake City, not after.

Compliance That Comes With Utah Residency

Living in Utah adds state deadlines to an already heavy federal and UK reporting load. The expat tax Utah calendar is straightforward, but missing it is expensive.

FBAR and Form 8938

Utah has no foreign account report of its own. However, as a US tax resident you must file an FBAR through FinCEN's BSA E-Filing system if your UK accounts, including ISAs and many pensions, exceed $10,000 combined at any time in the year. Married couples living in Utah must also file Form 8938 once foreign assets pass $100,000 at year end or $150,000 at any time. Missed FBAR filings are one of the most common problems we fix for newly arrived British families.

Utah Deadlines, Extensions and Prepayments

Expat tax Utah returns are due on 15 April, and the state grants an automatic six-month extension without any form. However, the extension only protects you if you prepay the lesser of 90% of this year's Utah tax or 100% of last year's, using the TC-546 prepayment coupon. Utah does not require quarterly estimated payments. Nevertheless, a large UK gain in your first year can leave you short of the 90% test, because your prior-year Utah tax was zero.

Missed Utah Returns

If you have lived in Utah, or stayed domiciled there from London, without filing, the state can assess every open year with interest. The same facts usually mean missed US tax returns and missed FBAR filings federally.
