As a result, UK income that HMRC has already taxed is treated better here than almost anywhere in the Midwest.

How Indiana Taxes High Earners in 2026

Indiana taxes high earners at one low rate on a broad base. For expat tax Indiana purposes, the state starts from federal adjusted gross income, makes a short list of adjustments and applies the flat rate. Therefore the arithmetic is simple, while the base and the county layer need care.

The Expat Tax Indiana Flat Rate and Its Scheduled Cuts

The Indiana rate is 2.95% for 2026. It was 3.05% for 2024 and 3% for 2025, and the Department of Revenue confirms on its rates page that it falls to 2.9% in 2027. The state has no brackets and no surtax on high incomes. Consequently, a $2 million earner and a $200,000 earner face the same marginal rate.

Exemptions Instead of Deductions

The expat tax Indiana base offers exemptions and little else. Each taxpayer, spouse and dependant receives $1,000, and each dependent child adds a further $1,500. Notably, the state has no standard deduction and ignores federal itemised deductions, so mortgage interest and charitable gifts do nothing. A family of four therefore shelters only $7,000 before the flat rate applies.

No Special Rate for Capital Gains or Dividends

Indiana taxes capital gains and dividends as ordinary income. A long-term gain taxed at 20% federally still bears 2.95% to the state and the full county rate. Furthermore, a gain on UK shares or a UK property enters through federal adjusted gross income in dollars. Hence currency movements can create an Indiana gain where the sterling figures show none.

UK Pensions Receive No Special Shelter

Under the expat tax Indiana rules, private pensions receive no general exemption. The state deducts US Social Security benefits and military retirement pay, but an occupational or personal pension is taxed in full. Accordingly, drawdown from a UK workplace scheme or SIPP bears the state and county rates. Likewise, the UK State Pension is not US Social Security, so the Indiana deduction does not reach it. Under the treaty a periodic UK pension is normally taxed only in America, which means no UK tax exists to credit.

The Rare State Credit for UK Tax

Indiana credits foreign income tax against the state charge. This single rule sets expat tax Indiana planning apart, because most states refuse any credit for tax paid outside America. The Department of Revenue's Income Tax Information Bulletin 28 sets out the rule and the evidence required.

How the Credit Works

The bulletin applies the credit to income from any state, possession or foreign country. The credit equals the least of three figures. The first is the income tax actually paid to the foreign country on that income. The second is the Indiana rate multiplied by the income taxed by both jurisdictions. The third is your total Indiana tax for the year. Therefore the credit can remove the state charge on doubly taxed income, and it never produces a refund beyond it.

What You Must Attach

Every expat tax Indiana credit claim needs proof. Indiana asks for a copy of federal Form 1116, or a Form 1099-DIV or equivalent statement where Form 1116 was not required. In addition, the return must include a worksheet showing how you computed the credit. In practice, we prepare the federal credit by category first and then trace each UK tax payment to the income Indiana also taxes. Otherwise, the Department denies the claim for lack of support.

Where the Credit Helps and Where It Does Not

The credit helps only where the UK actually charged tax. UK rent, taxed by HMRC at 20% to 45%, earns a credit that wipes out the 2.95% on that rent. Similarly, a gain on UK residential property carries UK tax of 18% or 24% and qualifies. On the other hand, a non-resident generally pays no UK tax on UK dividends or UK share gains. Consequently, those items bear the full Indiana rate, because no foreign tax exists to credit.

The Double Benefit With the Federal Credit

The Indiana credit sits on top of the federal one. The federal foreign tax credit reduces federal tax, and the same UK tax then reduces Indiana tax up to the state rate. Importantly, nothing in the bulletin requires you to reduce the Indiana claim by the federal credit. As a result, well-prepared expat tax Indiana returns use every pound of UK tax twice.

County Income Taxes: The Layer the Credit Does Not Reach

For expat tax Indiana purposes, counties tax the same income as the state and ignore UK tax. All 92 counties levy a local income tax, and for many Britons it costs more than the state tax on UK income. Therefore the county you choose, and the date you choose it, matter as much as anything else.

Rates in the Counties Britons Choose

County rates vary widely across the Indianapolis area. The Department's Departmental Notice 1, effective 1 October 2026, lists Marion County, which covers Indianapolis, at 2.02%. Hamilton County, covering Carmel and Fishers, charges 1.1%. Boone County, covering Zionsville, charges 1.71%, and Hendricks County charges 1.7%. Meanwhile, Monroe County, home to Bloomington, charges 2.14%. Consequently, the combined rate runs from 4.05% in Carmel to 4.97% in Indianapolis.

The County Taxes Everything the State Taxes

The county base follows the state base. A resident pays county tax on salary, bonuses, rent, dividends, interest, capital gains and pensions alike. Furthermore, the tax reaches UK income exactly as it reaches Indiana income. In contrast with the city taxes in neighbouring states, which often spare investment income, an Indiana county spares nothing.

No County Credit for UK Tax

The county credit covers only local taxes in other states. Bulletin 28 allows a credit against county tax for income tax paid to a locality outside Indiana, such as a city in Ohio or Kentucky. However, HMRC is not a locality, and the bulletin offers no county credit for national foreign tax. Therefore UK rent that escapes the state charge still bears 2.02% in Marion County. This is the expat tax Indiana point most online guides miss.

The 1 January Rule

County tax depends on a single day. Departmental Notice 1 states that your county of residence is fixed on 1 January of the tax year. If you live in an Indiana county on that date, its rate applies for the whole year. Conversely, if you live abroad on 1 January and have no principal place of work in Indiana, no county tax applies that year. Hence a family landing on 2 January avoids a full year of county tax, while a family landing on 30 December pays it throughout. Among all expat tax Indiana rules, none is cheaper to use.

County Changes Ahead

The county system is changing. Legislation passed in 2025 restructures local income tax, caps the combined local rate at 2.9% and lets larger cities levy their own rate of up to 1.2%. The change was scheduled for 2028, and lawmakers have since moved to delay it. Accordingly, today's county rates hold for now, but a Carmel or Fishers resident should expect movement before the decade ends.

UK Rent, Gains, ISAs and Pensions in Indiana

The expat tax Indiana treatment differs for each kind of UK income, because the credit follows the UK tax. Income that HMRC taxes fares well, while income that Britain exempts for non-residents fares worst. Therefore the pattern is the reverse of what clients expect.

UK Rental Income

On expat tax Indiana returns, UK rent usually ends up lightly taxed by the state. HMRC taxes the profit first, typically through the non-resident landlord scheme at 20% unless you apply to receive rent gross. The federal return then taxes the dollar profit, with depreciation over 30 years, and credits the UK tax. Subsequently, Indiana charges 2.95% and credits the UK tax up to that amount, leaving only the county charge. Notably, the federal and UK profit figures differ, so the credit worksheet must use the Indiana base.

Selling UK Property or Shares

Property gains and share gains part company. A non-resident pays UK capital gains tax on UK residential property and must report within 60 days, so the Indiana credit applies. In contrast, UK share gains generally escape UK tax for a non-resident, so Indiana and the county tax them in full. Additionally, the 3.8% federal net investment income tax accepts no foreign credit. Therefore selling UK shares before you arrive saves more than selling UK property early.

ISAs and UK Funds

An ISA has no status in America. Its interest, dividends and gains are taxable federally each year, then by Indiana and the county. Furthermore, UK funds inside it are usually passive foreign investment companies reported on IRS Form 8621. Because Britain charges no tax inside an ISA, no credit arises anywhere. Consequently, in expat tax Indiana terms, the ISA is taxed at up to 4.97% with nothing to set against it.

UK Pension Drawdown and the State Pension

UK pensions meet the full Indiana rate. The US-UK income tax treaty gives America the sole right to tax a periodic UK pension paid to a US resident. As a result, HMRC charges nothing once an NT code is in place, and Indiana has no UK tax to credit. Indiana Residency, Domicile and Hoosiers in London

For expat tax Indiana purposes, residency turns on domicile or on a home plus days. A resident pays on worldwide income, while a non-resident pays only on Indiana-source income. Therefore the residency date drives the state bill, and 1 January drives the county bill.

Two Routes to Residency

Indiana law treats you as a resident on either of two tests. The first is domicile, meaning the place you intend to live permanently or indefinitely and to return to. The second applies where you maintain a permanent place of residence in Indiana and spend more than 183 days of the year there. Hence a British executive with a leased Carmel house and children in local schools is a resident in practice, whatever the length of the visa.

Part-Year Residents

In the year you move, Indiana taxes income received while you were resident, plus Indiana-source income from the rest of the year. Bulletin 28 confirms that part-year residents file Form IT-40PNR on that basis. Accordingly, a UK share sale completing before arrival falls outside Indiana altogether. In our experience, combining that timing with the 1 January rule is the most valuable expat tax Indiana step available to a family planning a move.

The Foreign Earned Income Exclusion Flows Through

Indiana follows the federal exclusion. The state starts from federal adjusted gross income, so salary excluded on IRS Form 2555, up to $132,900 for 2026, never enters the Indiana base. In practice, this helps Americans abroad and rarely helps Britons living in Indiana, whose tax home is here.

Hoosiers Working in London

An Indiana native on a London assignment often remains domiciled in Indiana. If so, the state taxes salary above the exclusion and all investment income. However, the foreign credit changes the result. UK income tax at 40% or 45% far exceeds 2.95%, so the credit normally removes the state charge on UK salary. On the other hand, the county tax continues if you were an Indiana resident on 1 January, and UK tax cannot reduce it. Therefore many London-based Hoosiers owe county tax alone, and too many ignore their expat tax Indiana filing duty.

Case Study: The Hargreaves Family in Indianapolis

The following illustrative case study shows how the expat tax Indiana layers combine for one household in 2026. The figures are simplified, converted to dollars and rounded.

The Facts

Oliver and Meera Hargreaves are British citizens holding green cards. Oliver is a senior life sciences executive earning $380,000, and the couple have two children. They rent out their former home in Surrey, producing a $40,000 profit on which HMRC charges about $4,600. Their UK shares and ISAs pay $25,000 in dividends, and in 2026 they sell UK shares at a $60,000 gain. Their adjusted gross income is therefore $505,000, of which $125,000 is UK income. They live in a historic Indianapolis neighbourhood in Marion County.

The State Bill and the Credit

Indiana allows four exemptions of $1,000 and two child additions of $1,500, or $7,000. Taxable income is therefore $498,000, and tax at 2.95% comes to $14,691. The credit for UK tax on the rent is the least of $4,600 paid, 2.95% of $40,000, and the total tax. Hence the credit is $1,180, and the state bill falls to $13,511. The dividends and share gain carry no UK tax, so they earn no credit and cost $2,508.

The County Bill

Marion County charges 2.02% on the same $498,000, or $10,060. No credit applies, so the UK income alone costs $2,525, including $808 on rent that the state has just relieved. Had the family bought in Carmel, Hamilton County would charge 1.1%, or $5,478. Consequently, the address costs them about $4,580 a year.

The Lesson

The total Indiana bill is $23,571, of which $5,033 relates to UK income. Three decisions would have changed it. Selling the shares before arrival would have saved $2,982 at state and county level. Choosing Carmel would have saved $4,580 a year. Finally, the family arrived on 28 December 2025, so Marion County applied for all of 2026. FBAR and Form 8938

Federal reporting follows you to Indiana. You must file an FBAR when your non-US accounts exceed $10,000 in aggregate at any point in the year, as FinCEN explains. Moreover, US residents file IRS Form 8938 once foreign financial assets pass $50,000 at year end for a single filer or $100,000 for a joint return.
